Hey NQB can you tell me how the original posters post could lead to any legal ramifications , it is the rumour and unless you can prove he started it I'd suggest he has nothing to worry about legally , upon this board the superiors for this board may or may not see he's post like any other outside BF rules and if they did, or do, they'd take the necessary action !
Stop tearing up it's a tragic situation but don't come on here making legal insinuations , it's all over the public news domain and because you object to it being posted on here doesn't make it illegal !

youve all missed the bloody point, its about it being completely wrong to post names on a public forum to a crime allegedly committed 24 odd hours ago. Aside from that, the media actually very much screw this site to get their "exclusive" stories, so dont say things in respect for the people in question unless you can prove it, regardless of whether it comes out later that its true or not.

Its about respect for all parties in a fairly disgusting situation.

I would suppose that it would depend on how you framed the fluff. If you said
'according to New Idea...", probably not. If you just reported something as fact without a source, you may have more cause for concern.

Maybe because it's impracticable for him to do so. Someone who felt aggrieved may have an avenue to seek damages through suing the moderators though.

Anyway, better to be safe than sorry.

You libel someone if you publish in permanent form, and distribute to a third party, any statement or suggestion which lowers the reputation of an identifiable individual in the eyes of a right-minded average member of the public.

Repeating a libel originally printed in another publication, gives no immunity.

Being on the wrong end of a libel case can mean lifetime "game over".

the defenses are so robust tho, that actually winning as the plaintiff is remote and often not worth it even it was defamtory.

So It would need to be proven that I had lowered the reputation of the individual. Since the rumour was already going around, this could hardly be attributed to me.
The same reason no individual poster can be prosecuted by Steven Milne.

Hey don't get me wrong if he said player x is this or that I agree he'd be in the deep end , however he stated that it's the word around town and from what I can figure out he is quite correct it is the word around town. It's why newspapers use words such as allegedly , allegation etc etc .
 
Without looking at any legal precedents, logic would suggest that the particular means used to publicise the rumour would make a huge difference.
A national newspaper or magazine would be the most likely to be able to be sued for adverse publicity. Vexnews or something similar would obviously be less.
This forum would be slightly worse than hearing it in the pub.
If it is presented as a rumour rather than a fact then it would be even less of an issue.
Can you really be sued for repeating a rumour, if there is evidence that such a rumour actually exists, and it is not presented as a fact?
Do you know the names Bozo, how did you hear them, there are records of text messages, emails etc.
There may be caches of this forum which contain deleted posts.
If anyone tries to sue it could be very difficult to single someone out.
If you reread the posted question it was "is such and such a rapist?" This is treading on thin ice (with heated shoes) as it is confirming the criminal act and suggesting a name. Look at the news reports and it is always reported as sexual assault as that is a broad term used, not a specific criminal act. That is what I mean by these websites having proper reporters who know the libel laws and can usually judge how to write about sensitive issues. Posters on here are not professional writers but are blurting out what they think without really thinking about the full consequences.

As to whether someone would sue a poster on here, it would be difficult but not impossible and would cause a lot of extra hassle for BIG and their lawyers - leave the reporting of names and specific details to the websites that are used to it.

Only Collingwood could win a grand final oneday and tarnish it the next. Its like the old saying " You can take the boy out of Collingwood but you can't take Collingwood out of the boy".

I hope it's not true. I wish that Collingwood would release the names of the players involved just to stop the rumours and speculation. All that is certain now is that two players have been interviewed by police. One of those players played in the team on Saturday. I have heard a rumour about who those two players are but I would like it confirmed by the club.

I know what you mean.. he was just being very suggestive about it.

Anyway its gone into the press now anyway, the two players at the centre are pretty much named already.

So anyway, I hear they're talking about trading Dane Beams to St Kilda.

St Kilda do need some pacy outside runners, and I'm sure Dane would be an excellent cultural fit down Moorabbin way :thumbsu:

omg r u serious? i always thought da saints needed a speedy wingmen. andy lovett would have been the perfect candidate but this boy could be da trade that brings em the premiership
