She has openly admitted its about getting the St Kilda football club and the AFL. The indisputable fact is she had some intimate relationship with someone at the Saints and then has been able to access this stuff.

Unless you geniuses are of the opinion she broke into the blokes house and he has never met her either. She can change her story all she likes and still post pics, she hasn't broke any laws and the Vic Police won't touch a 17yo over an issue this minor.

Can you explain then the phenomenon of schoolies? Where thousands of recent school leavers travel to participate in a variety of drinking and partying. They have to be over-18 to do this, and I know all but a few of my graduating class were of age. I am from Victoria, which is the state she is from

I finished yr 12 at the age of 17. I turned 18 the following yr in june. Had about 3 mates in the same situation with me.

Check the room pics, they are exactly the same. She's been adamant that she took them in Melbourne earlier this year, where's that leave her to change the story to?
She won't admit she's wrong. George Bush/John Howard/Tony Blair all claimed the invasion of Iraq was because they KNEW that Sodom Hussein has WMDs. When the evidence came out there was no weapons and no credible evidence, they changed the story that they were liberating Iraq and installing democracy. When that didn't fly, they were stopping terrorism at its source. And so on. No admission of failure or error. She'll be like, well they treated me like shit. I can't believe you're victimizing me, I lost a baby and so on.

[Important point. I'm explaining how I see the psychology working. I'm not for a moment saying that this girl hasn't suffered real pain and anguish. I just think she's targetting the footballers (Gilbert might deserve it) because they're available (in the sense that she can get at them) and sadly that'll not help her mental state in the long run. There's more to it than that, but it's certainly a strong theme, revenge.]

Are you saying someone you know can't rob you?

Or are you saying that photos can't be stolen?

If you take something that belongs to someone else, without their knowledge, and with no intention to return it, that's theft. I'm pretty sure that theft is breaking the law.

Not so sure about that, this could be defined as criminal defamation. If she has published defamatory material, which she knows to be false, with intent to cause harm to the victim and it can be proven she may be in trouble. The more she carries on, the more she publishes, the more she says she took the photos, the bigger hole she is digging.

Her behaviour is nowhere near as acceptable as what people are making out.

I'm saying that part of the law is iffy at best. If I email aphoto off your hard drive to my pc or phone, it still remains on your PC, it's not like I have removed it. You have a facebook account? you get express consent from any person (including those in the background) before you upload it to any social network. No, you don't.

Not to mention, if Gilbert and her were in some sort of relationship, she was in his house, where doe the line start and finish? did he show her the photos? did he tell her abou the photos? did he provide her with a copy?

His lame response of 'its in the hands on Police' is legal spin akin to saying 'the cheque is in the mail'

It's also a civil matter not a criminal matter the Police won't get involved, she's also a minor.

stealing is taking something off someone so its no longer in their possession

copying something is something completely different

unless those photos are copyrighted - can you still a digital COPY of that image?

I have no idea - but i can pretty sure it wouldn't come under the theft umbrella. Photos get taken / copied of people all the time - i can't think of one instance where the person gets charged for it though - UNLESS copyright has been issued, or they have been published.

And how many other people at your school were in the same situation? At my school the average age at the end was 18
 
This is probably a stupid question, but is it possible for defamation to be criminal in the legal sense? I thought it was a civil matter. IANAL.
Criminal defamation cases are rare. Would more likely be civil. I would persue it civilly, to set a precedent. Shame you cant go for punitive damages in a defamation case.

A lawyer on TV earlier this evening said it was a case of theft if she took the files from his computer without permission.

It cant be defamation, for starters that's Riewoldt, and he's admitted to it. End of story. There is nothing defamatory about an image, its either him or its not. She's not alleging any sexual relationship with him in fact she's on record as wanting revenge on the Club.

She feels wronged, and given the crap way it was handled 10 months ago it was always coming back around. I have represented my fair share of lets say 'interesting' people and one thing that is always the case, there is always some merit and you cna't just sweep shit under the carpet and hope no one notices.

Cheers! Learn a new thing everyday. So you can defame the state? I mean, a criminal offense is one the state prosecutes, like rape or murder. Not one an individual brings against another individual.

This stuff is disgraceful....what on earth is this girl trying to achieve?

and 6 lawyers will tell you its not. You can get a lawyer to say anything as long as they are paid.
I thought Lawyers had to honestly inform clients of the likelyhood of success in a case. I wouldn't have thought a lawyer would go on TV and state something that wasn't likely. Oh wait, Doctors go on TV everyday and spruik bullshit treatments because they're paid. Why would ambulance chasers do any different? I stand corrected.

At the risk of appearing a concern troll I'll support the above. She may have acted like a total loser and abused lots of folks, but she's a person in the end. Probably a very hurt and lonely person. I'm not justifying her actions, just saying that underneath all that bullshit and bluster is someone not that different from us, if we'd gone down that road.

Oh God. I must be pissed already.
