In an affidavit filed with the Federal Court, Riewoldt's manager Ricky Nixon alleges the 17-year-old admitted she ''stole'' the photos from a laptop belonging to Saints player Sam Gilbert.


I know what was alleged. Thanks for pointing out the obvious, though.

It will be interesting however to see them (Gilbert and Nixon) prove it. At the end of the day it will be his word against hers, and the fact that she's an erratic 17 year old skank with a passion for becoming famous is irrelevant in a court of law.
 
I can only repeat, I apologise for not putting a sarcastic smilie at the end of my post.

That said people are pretty gullible if they think Gilbert and a schoolgirl were in anything resembling a "relationship".


Do you have contact with the outside world? FFS theres young people at our sports club that have been in relationships for years and you never see them with there partners thats how it is these days.

If Gilbert and the girl were together for years (instead of days or weeks) she wouldnt be a 17 year old schoolgirl any more and their wouldnt really be as much controversy.

I would take the word of a signed affidavit over some some attention seeker's ramblings any day.

This is the guy who was that drunk that he didn't see a tram until his car was halfway inside it. But he was sober enough to leave the scene of the crime.
 
Unless he has the original memory stick you would think he would be hard pressed to prove the photos belong to him. I think (a lawyer or wannabe lawyer can correct me) that in placing the injunction the onus is on them to prove ownership rather than her.

I think this will be the most relevant part of the case. Prove the girl is a social climber who would do anything to get famous and you kill all her arguments.

How do you do that in a court of law, when the law is based on facts not supposition.

And the proof of this I see you have not provided. In fact you can't even articulate what it is I'm meant to be saying.

My argument is quite simple on this point - a 23/24 yo Gilbert and a 16/17 school-girl does not constitute in my view a relationship. All the context around it would suggest what I asserted, earlier, this was hardly a romance. That's a view, feel free to form your own.

he is claiming IP, so in other words that the images are copyright protected. You don't need a copyright notice any more (the little c in the a circle), the presumption is that at creation, he owns the copyright and therefore its use and distribution.

So he needs to prove he is the author of the photo in the event there is a further step beyond wanting her to stop posting pics. You'd have to think that there are more, it was too late to stop those 3 so they must figure there are more about.

But its just a court order, there is no further action unless the parties then take their own further action. He could go her for some sort of damages but then risks the whole thing coming out in which case she could say all sorts of things on the stand eg you say he came to your school and you met at a nightclub, did you tell him that he had come to a school clinic at your school? so he knew that you were school aged either at or shortly after the meeting in the nightclub? Sounds like a messy trial that could answer questions you wouldn't want answered. Copyright infringement isn't exactly going to be some lucrative windfall on the back of a 17yo.

St Kilda would really be daft to follow this through the courts. Can't imagine her estate is worth much and the potential damage to the Club / distraction is not worth it.

I was speaking more in general, this thread being one example, and sadly for a couple of select posters - just about every other St Kilda related thread in the past 6 months.

It's an increasing trend that is incredibly boring, obsessive and further drags the standard down of the Main Board - which apart from one moderator who is making a valiant effort, is still the Bay 13 lite its been for the past few years.

I know Timmy engages in some banter with the likes of Falchoon etc, but I always viewed it as tinged with humour and wit, not malicious. On both sides. We had a Saints poster pop onto our board just recently and start a thread about stood down OPI cop and linking it to the investigation into our players. It didn't bother me overly and sunk like a stone.

A lot of Collingwood posters are supportive of Reiwoldt etc, so not particularly useful to generalise about the 'Collingwood' position, because none exists.
 
How did the girl at the center of this controversy go to the Brownlow?
