Isn't the pont here that Scott threw his blanky out of the cot earlier in the year and named players in front of the media, yet it's not ok for a QC in defence of a charge to claim that Lindsay dived?

I've never said. The point is this was in the tribunal and not a press conference before a game.

So official comments in a tribunal are different to official comments made by a club's senior coach after a game?

The plain truth is that your senior coach came off the long run after the round 6 game this year and blatantly accused our team of cheating in a press conference. Might I add that there wasn't any West Coast representative there to refute what he said.

Luke Shuey goes up at the tribunal 9 weeks later and insinuates something about one of your club's players of diving, and there's a furore over it and North fans are angry that Thomas wasn't there to defend himself??

Please. Get your hand off it. There's no reason for your anger and there's no difference in the situations. Your coach fired a shot at our entire club, so we return serve at one of your players.

The sensationalist VIC media should be banging down the doors at Arden Street for Lindsay Thomas to have his say. They'll then paint him as the 'victim' in all this, continue to paint our entire club as evil (nothing like a paranoid VIC media when we're doing well), and things will go on.

Their response was to leave the stand and offer to fight me behind the goals in front of a bloke with three kids sitting the row in front of me for DARING to respond to their crap from earlier.

If you wonder where we get the Victorian connection from, I'd say to you that it comes from the fact that it's basically only been the victorian clubs, media and fans that have been digging in.

Don't see many interstate supporters giving a shit.

there are two points for debate here - the first being inconsistency at the tribunal the second being Archers opinion.

Firstly, the MRP and Tribunal are terribly inconsistent and in my opinion the incident deserved one week - its stupid and not a good look (i cite the judd v pay incident where high contact drawing blood from a look-away swinging elbow was not deemed sufficient force/jarrad waite look-away back kick to the groin of a richmond defender not sufficient force etc).

Secondly, Archers view is that players should look after each other - but pushing this to its full extent is having Thomas give evidence that there was nothing in it and that he was trying to milk a free (i cite campbell brown lying to the tribunal over the judd eye gouge). In the end it amounts to the same thing.
 
I know the tribunal isn't as strong as a court of law but why don't QCs try using precedence more? For example, if it was in court, surely you'd run the Judd elbow of Pavlich from last year and argue inconsistency?

Inadmissible, AFL needs its wiggle room for contriving sentences.

Because the tribunal cares nothing for justice and consistency, but rather pandering to the whim of the administration at any given time.

With that said, numerous other tribunals in the Australian legal system don't/aren't allowed to use precedent as a binding rule.
