The common thing in both incidents is that the "victim" is playing a sport when most people would say they are no longer fit to play it. While I think people should be able to determine risks about their own body, the other players in the sport also have a right to play against players who are fit to play. If people whinge about murphy getting hurt, it might cause the players who come into contact with him to be suspended, but in the long term, the AFL will start to stop players like Murphy playing. This is what it is determining now. Rather than whingeing about the incident, friends of Murphy should be downplaying it as a normal footy incident....although you could argue that real friends of murphy would hope that he isnt playing next year.

It's not ethical for Murphy to continue playing. I'm no doctor but CTE seems very likely based on the amount of players who are emerging to have a form of the disease with far fewer concussions in their history. Murph won a flag some never get, should make the decision easy.

I dont know about the ethics. Just the practicality. He has a weakness that makes him more susceptible. We havent heard other players complain but if players like McCarthy are cited next year then this defence is going to be raised more often. The question might be raised as to whether players like Murphy or McCartin are going to be treated as if they have a disability. Thats unworkable.

At the end of the day I hope he gets the best medical advice he can on the concussions and the potential outcome if he suffers any more. If the medical advice is that he can keep playing then so be it, if they tell him to step away from playing football for the sake of his health then I hope he does.

I’m no doctor is your key phrase. Leave it to them. CTE is more about repeated little knocks.

The medical panel will conduct a medical assessment. Premierships aren’t part of it.

I'm surprised that the AFL will only make recommendations to a player.

It could be a hint hint nudge nudge sort of recommendation so it looks like Murphy chooses it. Like with Max Lynch.

Unethical? That’s overly dramatic.

It would be unethical for Collingwood to ask a Murphy to continue to play against medical advice to the contrary. But a player making an informed decision about their own health/life/career balance is hardly unethical. It might be a bad decision or one you/we disagree with but it is his to make.

Some people choose to work in coal mines, or as abalone divers, police officers, racing drivers, etc, despite significant health/death risks. I doubt you’d call any of those career choices unethical.

i think it's a legal thing. My mate wipey is an expert in avoiding litigation and he'll probably advise here...

But I have a story that might illustrate the issue. There were bushfires in WA a couple of years ago and power poles fell down and started fires and other damage. They were on private land....owned by the farmers etc. There was an inquiry and the power company was still blamed and still fined, because it had a duty to warn the farmers of the faulty poles that no one realised was faulty....

So i got a bloke at my door a few months back and he provided me with a piece of paper recommending that my slightly leaning privately installed power pole needs to be replaced. Not telling me....just advising me. Why?

Well if the pole falls down and causes a lot of damage, the power company can show the paperwork and its not liable for any damage. It can walk into the sunset knowing that it advised me to replace the pole and I didnt do it and I'll wear the cost....

So Nathan gets the paperwork and if he gets brain damage in the future, the AFL will wave the paperwork and say that it told him that he should retire...that's why god invented lawyers...

The AFLPA would have something in the standard contract that prohibits the AFL from acting to end a career (contract).

I doubt it. Players agree to registration and have their rights restricted as far as picking their own employer. Leigh Matthews was deregistered for 4 weeks. I dont know if those aspects of restricting free trade have been tested in the post brett chalmers era, but the AFL might be able to deregister Murphy on the grounds that he isnt fit to play. The thing would have to go to court and wipey would have to take over and spin his web of mastery and see if he could get the thing overturned......however, employees have protection against unfair dismissal and unlawful dismissal and I'm not sure deregistration would count....

It's unethical for someone who isn't a doctor to be giving medical advice based on a couple of articles about different medical cases ...

Unironically anyone at home who's read some American papers on CTE knows just as much about the issue as an Australian doctor.

Doctors don't have access to special secret information, and our knowledge about the brain is super limited.

There's reading and fully understanding and if you're not qualified you really should just sit back and let those who are give advice to the player. KinderSmock has previously linked a newspaper report where he misinterpreted what was said about percentages of NFL players with CTE - let alone a medical journal. Needs to just let it play out amongst people with far greater understanding.

but if he's so old, he's driving on the wrong side of the road, then your lawyer, wipey, might be able to get the charge downgraded because the old bastard contributed to the steering wheel impaling his head...

These are the same doctors who are sending concussed players back out onto the field. That's the problem, we're decades away from really having a good understanding of the brain and how certain things impact it

So in the meantime we should take medical advice from kindersmock?

Your heart is in the right place on this, and I support your instinct to protect the lives of players.

I trust that the people who will review Murph's case are of the same inclination and more qualified than us to advise correctly.
 
I don't know what will happen with Murph but I do know that he has a glass jaw and and that's not a good thing to carry around the football field

I have the same concerns but they extend to Murph the person moreso than Murph the footy player.

If he's deemed good-to-go then awesome else he's young and has every opportunity to build a good life outside the club, as long as he stays healthy.
