In his defense (since he's probably napping) he probably wasn't ready yet to order a killing and thus is probably good. Besides, if he doesn't wake up and vote I think he dies anyway.

Voting is not compulsory in ToS, so we'll have to lynch him at some point if we want him gone. No neutral killing kill overnight which could mean anything really.

Also the first night phase was over 36 hours long so even he might have gotten an action in.
