He’s already publicly said it was partly his decision to return to the field, that alone would put a big scupper on any negligence claims.
That depends if he was given the correct information on the extent of his injuries and the associated risks.

In suggesting it was Petraccas choice to return to the field, then you’d have to believe he did so against Medical advice which I highly doubt was the case.
 
If a player refuses to go to any other team and is willing to sit out the year then the whip hand is no longer with that team.

This is my point.
Grundy despite being kicked out refused to deal with any team bar Melbourne it limited the clubs ability to maximise a trade.

Treloar the club had agreed to a top 5 pick to GC but Treloar refused to go there and instead nominated the Dogs as his only team and we again took a pineapple up the rear.

Do you not see if the Rumours that Petracca is done to the point of willing to sit it out and that it's Pies only at this stage how Melbourne's position is not one of power?
I haven’t seen anything about Petracca being willing to sit out for 12 months. That’s just BF hyperbole as far as I can see.

Until the above becomes an actual reality that’s been reported on, the it’s not legit, and your theory ignores the fact we were actively trying to move those two players out. If Melbourne want to keep Petracca, and Petracca is contracted, they still are well and truly in a position of power if a trade is requested.

How does that work for past players suing for concussion? They've likely said they wanted to go back on too or play the next week.

I really don’t see the difference, it’s all about motivation.
We needed salary cap relief, Petracca is strongly motivated to end his time at the Dees. That will put significant pressure on the Demons who will potentially wish to “buy” the silence of Petracca and his family by taking unders. The Dees motivation to “buy” their silence may be much stronger than we think.
Jeez you can come up with some nonsense but that one was especially good.
 
It’s hypothetically possible against the doctor but extremely unlikely.

I’d say it’s either just a rumour or it’s being used by the Petracca camp because he wants out. Most of the public think the club shouldn’t have let him back on so they can milk that if he wants to leave.
Whether there is language in the contract around duty of care, or whether it’s duty of care under common law, why would it be only hypothetically feasible in relation to the doctor?

I would have thought a duty of care scenario would involve many individuals, many moving parts, and likely multiple incidents. Even if not, the doctor is contracted to the club, so the club may be held liable for his/her actions, similar to Collingwood being taken to court for Kelly’s alleged comments, no?

I do agree that if there’s truth to the rumour, it’s almost certainly an ambit claim designed to force Melbournes hand. Neither Trac nor the club would be interested in the situation devolving into a court case.

I'd rather not go for Lynch if we can help it, his nearly 32, always riddled with Injuries and far from his best.

Walker is another one that's old and finished. It would of been great to have thrown the kitchen sink at petracca or smith had we had better draft capital. Can't see us landing any big names this year sadly

Using lawyers to get him out of a five year contract to then cross to Collingwood? Do you really think MFC supporters would be OK with that? I reckon most would see him as a traitor.

That’s not quite true. They’re on track to accrue 5 1st’s across their 3 trades which will leave them with 6 so unless they can find some trade partners to move up the order they’ll need to ask whether 6 picks under 20 is better than 3 under 10 in 2024 and 3 under 20 next year.

As an FYI if Collingwood were in this position I’d want us to trade at least two into next year. I’m a subscriber to spreading the influx of talent because the more early picks you have the greater the chance some slip through. There may be an opportunity there to move a pick from 2025 into 2024 in a Lynch deal.

Duty of care is a concept in tort law, not contract law. There is nothing in the SPC about DoC.

They hold power to refuse a trade and risk losing him 12 months later for less as a 29 turning 30yo who may of sat out a year.

The whole trade scenario is BF rumour at this stage and tearing up a contract to completely quit Melbourne is part of that rumour only way to effectively do that is sit it out.

It doesn’t matter that we actively tried to move them out, the real factor is both refused to deal with more then 1 club.
Gold Coast had agreed to pick 5 for Treloar, we couldn’t get Treloar to move (why because at that stage there were other teams involved).
He settled on Dogs as the only suitor, this is why we had very little negotiation power as it was one team only, no bidding wars, no secondary teams upping the deal to barter off against the other.

It was effectively take it or leave it because the player won’t go elsewhere.

Trac and Pies could orchestrate the same despite the reason being different.
 
Battle is so good.

He is exactly what we need and exactly what Moore needs.

I'm not against paying him that money and at 25 he is exactly the age we need.

I think a late burst of winter weather and some good snowfall would ease their concerns.

Petracca may play very little football next season. We might be best to focus on recruiting him in 12 mths.
Let him recover for the next year, his value may diminish slightly and we’d be in a better position to trade.
