Because nobody wants to work as a contractor if they can get employment as a consultant precisely because of the IP issue.
My father was made redundant by a certain large mining company about 5 years ago after working with them since school. He started his own consulting business, did a few short term contracts, and within 18 months his former employer hired him back as a consultant to do essentially the same job. He's been with them ever since.

Valid point. This convention is a fundamental flaw in Australian democracy imo. Julia Gillard does not have a mandate.
