Technically you are probably right, but if someone ended up charged with sexual assault every time that happened in a night club on a Saturday night the courts would be overflowing. As I said, if he had been some random guy she would probably have just told him to get lost and moved on.
It was probably a dumb thing for him to do depending on the circumstances.
