Will Clive Palmer win in the High Court re hard border border issue and section 92 of the constitution?

In my opinion, Yes.

The High Court has accepted that states can limit the free intercourse between states but only if they are reasonable and imposed for a legitimate end, such as protecting the public from a dangerous disease.

So is the limitation both legitimate and reasonable?

Legitimate? Hell yes

Resonable? Almost certainly not.


So if WA does not make the border closure more balanced, than I consider they will be rolled in the High Court.

Does this mean they are powerless? No

Let Clive in, let him get 10 metres in & put him in quarantine. In a desert camp paid for from his pocket for 2 weeks plus everytime he enters the state. More than one way to skin this fat cat.
Clive Palmer should be where he belongs... in jail.
 
Not a question of if it was reasonable and I’m not clear on what the AFL were wrong about.

Do teams have to quarantine each time they come into WA?
The AFL were wrong to think that McGowan was being unreasonable when it’s become perfectly obvious that his response was reasonable. Even now there’s some in the AFL industry arguing against Perth hosting the grand final on the basis that ‘WA has done nothing for the AFL’. This is despite us hosting four Victorian teams at present, two NSW teams to come, potential for more and being the only state contributing significant coin into their coffers. The AFL should have accepted the conditions proposed by WA and SA, set up hubs, and things would have been much smoother than the last couple of weeks. Instead, they told the states to sod off, they’d host it in Victoria, what could possibly go wrong?
 
It'd be nice if some of the posters in this thread outside of Victoria were a little less insular and realised that this virus has overran and decimated pretty much the entire world. Even countries like Hong Kong and Vietnam that appeared to have things completely under control with no community transmission for months are now seeing cases spike. If it was simple to beat this virus there'd be no global pandemic. Consider yourselves very fortunate that your states are doing this well, enjoy the freedoms you currently have and just hope that the odd rogue case who escapes from quarantine or fraudulently bypasses the border isn't a contagious super-spreader that rapidly infects the community and shuts you down again.

Haha, I set my location and my "other teams" (I mean, Cameron White in 2020 FFS?) back in 2004 when I signed up and I've never bothered to change them. I haven't lived in Melbourne for over a decade so I can still aimlessly walk around outside at night, I'm now just not allowed to go inside anywhere.

We are acutely aware of this.

thats why mcgowans border policy has 95% approval - you can bet that the hotel security arrangements are being constantly reviewed and we count ourselves lucky that the mining companies in wa would have us stay in quarantine for 10 years if thats what it takes. They are screaming in mcgowans ears to keep everything closed.

The money in Vic, nsw and qld are demanding that everything be open....
 
Queensland won't have an outbreak, they've shown they are able to handle the pandemic far better than the Victoria and NSW governments.

They've eliminated community transmission for starters.

NSW never achieved elimination with Covid, they always had a handful of local cases a week even at its lowest point. That is the key difference here. Those cases in the community lead to undetected transmissions which can cause outbreaks.

QLD on the other hand achieved elimination, for more than 2 months. We can say with 99.9% certainty we did not have any undetected transmission in that time. In fact, we are the first jurisdiction in the world to have had 2 Covid free months, and then have new local cases re-appear.

That’s why we have a reasonably good chance of containing this breach, it’s currently the only source in the community we need to trace, and we can do so extremely effectively.

Look at me we are so superior because a virus didn't spread here as much as it did in Victoria, **** Victoria

Just pretend you already might have the virus & you don't want to hurt anybody with it.

That's the key. At the end of the day everyone has to ask themselves: if I had the virus today, would I have spread it to anyone else? The more often that answer is no, the better off we're going to be.

The demographics of Eagles members has meant we actually haven't been selling out yet, they've been very cautious about going. The upside of full capacity probably isn't that much at this point in time and the optics of still being cautious may have impacted community behaviour.

Obviously Freo may be different though.
