If Cochrane and the Suns weren't being spoon-fed by the AFL atm then the prospect of the Suns taking Martin in the PSD would make likely a mouth-watering legal challenge to the AFL trade system. From a constitutional perspective (i.e. corporations powers and reasonable restraint of trade clauses - TPA) it would be so interesting to see a challenge to the AFL draft system take place (there hasn't been a challenge since introduction in 1986) and would give the HCA new ground to explore how restraint of trade clauses, when faced with this limited form of 'restricted' free-agency, can reasonably be restraining of a player's right to contract.

I also would not be surprised if Martin did bring that challenge if the Suns decided to force him to remain at the GC despite him being a RFA who has committed 7 years of service to the club and has seen out his contractual obligations. It's also really clear that the AFL is concerned about challenges to its player movement system (particularly as it pursues the holy grail of an equitable competition) and this is arguably why FA was introduced in the first place.

The only problem is that the Suns and Cochrane are so reliant on the AFL at present that Gil would immediately and easily intervene in any plans Cochrane might be hatching to pick Martin up in the PSD. If the situation involved Collingwood (instead of the Suns) and Eddie Mcguire (instead of Cochrane) then we could be looking at a real stand-off with the upshot being a potential legal challenge. IMO it won't happen and Cochrane's threat to pick Martin in the PSD is an empty one given the support they're currently relying upon from the AFL and Gil but it would be juicy.

There are no grounds for a legal challenge. Period.

Gillon will be supporting any GC Suns decision that enhances their capacity to retain players into the future. Mark Evans has been installed by City Hall to oversee this harder line policy in concert with Cochrane.

Carlton’s interests in the matter carry no weight.
 
Get your numbers right. It’s $650k a year over the 5 years of the contract. Slightly overs but manageable when you account for inflationary pressures on AFL player wages over a half decade.

As a business decision it’s okay. It’s the ripple effect on the organisation and its standing among rival clubs which makes it a no-brainer.

How does giving a 5 year >$3mil contract to a player remotely enhance their capacity to retain players?
It literally just means they have money locked up in disenfranchised players as opposed to players that actually want to play for the club.

$3mil over 5 years for a talented half forward is reasonable for Jack Martin. The emotional guff of him wanting to play with Eddie Betts will quickly subside and he’ll get on with the job of being a professional footballer on the GC.

The fact you still think it's in the Suns best interests to re-draft him is admirable.

Why pay Lukosuis, Rowell and Anderson when you can pay someone who has wanted out for 12 months.
Those 3 are the ones who need to have 10+ year careers at the Suns to ensure the club survives.

Interesting that it took a front-loading like that to ensure Melbourne couldn't afford him. They must have a decent amount of salary cap mobility if that is the case. Also really interesting that we'll be paying him around $360k for the final 3 years which will be below the competition average - would be a strange adjustment for Martin going from $1 million per year to $360k.

Melbourne have quite a few bog ordinary players on big money (IE Steven May) apparently

Anyhow I am sure they probably could afford him if they wanted to, unfortunately Martin in no uncertain terms does not want anything with the Dees. He is, in his own way, a free agent who will end up at his nominated destination (admittedly in a roundabout way)


The cynic in me suggests that the AFL are happy for Martin to slip to Carlton (add to round 1 opening round blockbuster against The Tigers) but have encouraged Tones Cochrane to go through this ridiculous charade in the media threatening to retake him in the PSD, so the AFL is still in the news, right up and after the national draft.

I have no worries or doubts at all now that Jack gets to Carlton, probably part of the deal of the Suns rescue package was for Tones to keep dragging this saga on for months, to keep AFL footy in media circles long after soccer/racing and crickrt season starts.

The AFL have been doing this kind of crap for years, which is why supporters of the round ball code (A League) tend to get pissed off with the AFL and amount of media influence in Southern States (esp Vic and WA)

You said desperate, given the fact we expected to get all of papley, coniglio & martin we could easily make it 2.5mil in year 1 and 150k for the last 4 years.

For gold coast to have him next year they have to draft him and they don’t determine his price...$650k is not a thing...do you honestly think Martin will sign for longer than 1 year if he doesn’t want to be there?

5 is the number of years stipulated on the contractual terms submitted.
 
You don’t get it. The Suns have been down the path of ‘cutting their losses’ when trading. It doesn’t work for them. That’s why they’ve changed policy and are going to make an example of Martin.
I know that you don’t get it. But that’s ok, I enjoy reading your posts regardless. It’s all pure AFL engagement. :)

Retaining Martin helps them to retain those players. Martin will be on marginally higher money than he was on previously. It won’t hamper the Suns’ ability to pay others.
