There is probably a strong argument that this is an unreasonable restriction of trade... But anyway. AFL will always do AFL things.

The entire concept of a draft is a restraint of trade, which is why the NRL doesn't have one anymore. AFL survives only as long as no player challenges it.

Yeah, your right. I can actually see that happening with the shitshow that is the AFL.

The salary cap is an even bigger restraint of trade. But because the AFL isn't run by dumbasses (unlike the NRL), they, and all the players understand why the draft and cap is needed.

Take way the draft and cap and all the good players migrate to West Coast Collingwood, and Hawthorn, those teams share the flag year in, year out, and a whole heap of clubs die.

I think it's just accepted that the draft and cap in the AFL are restraints of trade but they necessary and specific to the industry. No club in their right mind will challenge it (remember what happen with the break away euro soccer league), and if clubs don't want to challenge it, how does a player go to court and say "I was restrained because I want to play at Collingwood and this draft thing doesn't all me" when Collingwood's position would be, "Huh? who's he? We never said we wanted him".

How come that doesnt happen in the NRL?

Broncos are a big club, as big as the Eagles. They just spent 2 or 3 seasons being crap. And only now are improving again.

Where's Naish at? Do we think he will be kept on after this year? Has fallen out of favour recently.
He was on the WCE podcast with Oscar Allen and Thumper this week, went to WAFL to improve his midfield craft. He said at the end of the Richmond game his ex teamates were telling him it was probably his best game for the Tigers given his 2 defensive 50 turnovers that both resulted in goals :laughing:

If he was a new draftee you hope he would grow out of it but he has been in professional environments since he was drafted so

Is it a restraint of trade?

Players are free to play country football, state football and amateur football so I would argue there is no restriction to playing the game.

The fact that the AFL pay the most $$ is irrelevant to whether it is a restraint of trade.

An engineer on an oil rig earns double to treble the salary if many softly located jobs in a city. They are subject to massive compliance requirements but you would not say there is. My restraint of trade

I don't think consistency is the issue. It's rare young players are not inconsistent. You just keep playing them until the gap reduces and if the gap doesn't reduce you delist them. But he's out of favour after a handful of games where he got a ton of ball.

His decision making and disposal are not AFL standard and history tells this that this is hard to fix. This is the reason why people melted their shit over Priddis. He wasn't AFL standard. How he won a Brownlow I will never know. Total imposter from David Icke school of thought. Maybe not a lizard, but a WAFL player for sure.
