In Daily stated that Pirt Adelaide is reserving its right to sue the Seven network over its reporting. Stage is set, time to make it happen.

Notice that Gill has been nowhere to be found in relation to this?

He keeps his distance from anything controversial or difficult and defers to other departments to do all of the heavy lifting.

DAVID Koch has released a pointed statement which is set to send shockwaves across the AFL.
The Port Adelaide president is furious at the league’s handling of an investigation into an alcohol-fuelled incident at a nightclub involving one of his club’s players, midfielder Sam Powell-Pepper.

In a statement provided to Triple M, Koch accused the league of “railroading” the second-year player in an attempt to rebuild its reputation in the wake of its own scandals.

“The whole respect and responsibility policy leaves the clubs in the dark. They (the AFL) take complete control. I issued them with a grievance notice before they would start talking sense,” the statement read.
“My biggest issue was they were railroading a kid in trying to rebuild their reputation with women because of the misdemeanours of their own former executives.

McGuire indicated Koch’s outburst came in a climate of growing tension between clubs and the league.
“The clubs are getting sick of being treated like franchises,” he said. “The AFL Commission was brought in to place to act on behalf of the clubs. There is a very strong feeling the clubs are there as a necessary impediment to the AFL hierarchy.
“In recent times you’ve had a message come out ‘we’re changing your theme songs’. This situation (with Powell-Pepper) — no impact from the club.
“(The clubs feels like the league is saying) we’ll tell you what to do. You can’t stand there. Banners got to be this big. You can’t have this sponsor. You can’t have your sponsor on the ground because we’ve got an ambush sponsor on your ground on your day.
“It’s building and building and building and has been building for a long time.”
 
So basically as a club we won't be taking this further its up to SPP and his manager to go to the courts if he wants?

No, I'd be perfectly happy with this going through the courts, however KT fronting the media and telling the world that Elspeth Hussey should eat a bag of dicks, while dropping his pants and windmilling for the cameras is not the way to do it.

Name and shame her, but do it in a way that'll actually cause some damage........... not the childish way she's done it.

Definition
Section 20 of the Criminal Law Consolidation Act 1935 (SA) outlines the offence of Assault.

Assault occurs if there is any intentional and unwanted physical force used against a victim [s 20(1)(a)]. For example, punching, hitting or kicking a person. The force used can be direct or indirect. For example, if because of an assault, a person drops a child they were carrying, that is also an assault on the child – even though the child was not directly assaulted.

Assault also occurs if there is any intentional and unwanted direct or indirect contact with another person, however slight the contact may be, if the person committing the assault knew that the victim might reasonably object to the contact [s 20(1)(b)]. For example, it could be throwing a newspaper at someone, knowing the person might object to that.

Assault can occur even without physical contact. If a threat is made to apply force and the victim reasonably believes that the person can carry out the threat or there is a real possibility that they will [s 20(1)(c)]. For example, if a person points a gun at someone or produces a knife.

An assault can also occur when a person accosts (approaches and confronts aggressively) or impedes(blocks the way of) another in a threatening manner [s 20(1)(e)].

What is not considered assault
A distinction is made for behaviour that falls within the limits of what would be accepted as normal social interaction or community interaction. Such behaviour does not constitute assault.

Examples of such conduct include acts such as patting the shoulder of another person to attract their attention, or pushing between others in order to get out of a crowded bus. Although these acts involve intentional touching of another without their consent, provided they are committed in a non-hostile and inoffensive manner, they do not constitute assault.

In addition, any conduct that is justified or excused by law is not an assault.

Maximum penalty
  • Basic offence: two years imprisonment
  • Aggravated offence: three years imprisonment
  • Aggravated offence by use of, or threatened use of, an offence weapon: four years imprisonment

Causing harm

Another form of assault is the offence of causing harm [Criminal Law Consolidation Act 1935 (SA) s 24]. It is similar to assault causing harm but the penalties are more severe.

To be guilty of such an offence a person must cause harm to another either intending to cause injury or being reckless as to whether they do so.

Harm can be either physical or mental, and includes pain, disfigurement, unconsciousness and infection with a disease. Mental harm includes psychological harm but not emotional reactions such as distress, grief, fear or anger, unless they develop into psychological harm [Criminal Law Consolidation Act 1935 (SA) s 21].

Maximum penalty
Causing harm with intent to cause harm:

  • Basic offence – 10 years imprisonment.
  • Aggravated offence – 13 years imprisonment.
Recklessly Causing harm:
  • Basic offence – five years imprisonment.
  • Aggravated offence – seven years imprisonment.
Causing serious harm
A more serious charge is that of causing serious harm [Criminal Law Consolidation Act 1935 (SA) s 23]. Serious harm includes harm that endangers or is likely to endanger a person's life, results in serious and protracted impairment of a physical or mental function, or harm that results in serious disfigurement [see Criminal Law Consolidation Act 1935 (SA) s 21].

Maximum Penalty
Causing harm with intent to cause harm:
  • Basic offence – 20 years imprisonment.
  • Aggravated offence – 25 years imprisonment.
Recklessly Causing harm:
  • Basic offence – 15 years imprisonment.
  • Aggravated offence – 19 years imprisonment.
There is provision for the court to impose a penalty exceeding the prescribed maximum in cases where a victim suffers such serious harm that the Director of Public Prosecutions feels a higher sentence is warranted [s 23(2)].

How is a decision made on what charge to be laid?
Whether a person is charged with common assault or some more aggravated form of assault will be decided by the police. The crucial questions will be the degree of injury to the victim, whether the victim is a vulnerable person and whether or not a weapon was used.

The cops haven't laid a charge so its not assault. So 7 were wrong to use the phrase sexual assault or assault even if they think they understand the definition of assualt.

Forerunner to the 7 news - Elpseth Hussey opened without their favourite "hand up her skirt" comment, saying that he was alleged to have put his hand down her skirt. I suppose we have to be thankful for small mercies. They must have realised if they kept on that tack they could have got into serious trouble.

And I don't watch seven news - this came up when I was watching "The Chase". The English one, the Australian one with w***er-in-chief Andrew O'Keefe is crap.

Huh, that's weird. Hours go by and not a single tweet from 7 News, La Hussey or the Goat Blower about KT's presser. Not one. Nope.

(Unless you count the "tonight on & 7 News" promo that leads with SPP but not really.)

After the barrage following the initial "sexual assault" report, I thought they would've been all over it.

That’s never been the way it’s worked with reporting though. A reporter is allowed to say so and so allegedly robbed a servo whether or not charges have been laid yet or will ever be laid, provided they use ambiguous language.

I think there’s plenty disgusting and unethical about what channel 7 have done but legally they’ll be fine.

Whenever something like this crops up, McGuire always emphasises what the Commission's role was intended to be and has clearly gone away from. Imperial overreach.
