sue him? For what? Seriously, you're a mental midget if you think they can sue him.

Try and think it through, I know it hurts. Brisbane released him from his contract, after they refused to modify his role and refused to trade him. Hence, there is no legal relationship between them.

Ergo, they can't sue. You follow?
Ok **************** maybe not sue him as such but they can do other things.

I am talking about the meat market at the end of the football season this is when it should of occured not now....it is blatant rorting of the system...can you for one minute think about the whole thing? surely he must sit out until 08 otherwise it is against the spirit of the game....

Oh, so the draft period isn't over?

The word you're looking for is trade, and from all reports, Brisbane wouldn't trade him.

But in the same way Essendon missed out on a priorty pick at No. 3 this year because the rules changed, this deal is above board and legal. Maybe next year it might not be possible

Actually I'm not sure about that. I'm happy with the 'above board' part of it, I don't think Michael has been malicious or schemed to find himself out of his Lions contract and in a position to look for a new club.

It's the 'legal' part, and I think that will be tested.

Personally I think one of the issues it will come down to is when he was very first approached by another club, or as it has turned out, Essendon.

Just because a player retires, doesn't mean they are uncontracted or delisted from the time of the announcement. It means that say a player 'retires' mid year, he won't be playing for the rest of the year and an agreement has been made in relation to the finances of his contract. It doesn't mean his contract no longer exists. It still exists till 31 October of that year.

The 'spirit' of the agreement/dissolving of contract/retirement will also come into play. Under what circumstances the arrangement was agreed to.

As I said on another board, the retirement of a player is a loss a club wears. But the club is under no obligation to wear that loss for themselves as well as it become a direct competitors gain.

Im under the impression all delisted players are automatically entered into the drafts. A player who has retired would simply say he isnt going to play to any club that drafts him (ie. Tim Watson at West Coast in 92).

SHould Essendon have come out on Draft Day and taken Mal Michael with a PSD pick after Carltons but Carlton under the assumption Mal MIchael had retired taken another player, that would be tampering. Carlton have set in stone their selection of Ackland so this greys that area a little. I think the AFL lawyers should have a nice close look at this one, but meh Essendon is one the clubs who have the money and the inclination to blow the whole draft salary cap thing away in the courts as a restraint of trade, so the AFL wont look to hard for fear their whole little equilisation process be deemmed by the ACCC as unfair..

surely the afl will jump in and stop this, it is clearly not fair to a club (brisbane) who have given him so much. If he does this he is a disgrace and so is the AFL for having allowed it

No they aren't automatically listed. They have to nominate. The rules were also changed so a player can't say that anymore. If you chose to nominate for the draft you agree to being signed by the club that picks you.

Absolutely, if we approached him whilst still contracted, there'd be an issue. But there's no suggestion we did. Essendon have fallen on their feet here, and played it smart. I'd be very surprised if anyone could prove that we spoke to him. After the decision to cut Michael was made, and no legal relationship exists, we can speak with anyone we like.

The spirit of it is where the debate lies. But I think that's between Michael and Brisbane, not Essendon.

Exactly.

Now he has signed with Essendon.The AFL have agreed to his contract.So it would be my club wasting money sueing Mal,Essendon and the AFL.

Malicious, no, but to be part of something that really stinks and is a low act, yes, he is very much involved, and that makes him part of the scheme.

He knows exactly what he is doing, and everyone who has any moral fibre finds it offensive.

How do you know we manipulated anything?
How do you know Mal's manager didn't approach Essendon?
How do you know Mal and Essendon didn't talk until Monday?

If you are going to slight mud, have some proof.

Not in '06 no, doesn't mean he still doesn't have it in him, you never know.

Believe it or not, he's actually never been AA.

There's going to be some interesting grudge matches involving Brisbane next year isn't there?

I agree, but it will also be between Brisbane and the AFL and the end result with affect Essendon as in if they will indeed be able to sign him.

But if the AFL have already agreed to it, as they have, it's an entirely moot point as there won't be any legal action.

If it's a concern, legislate so it doesn't happen again. I liked your idea around that. But this horse has bolted.
