Yeah, the mediation session here is crucial. Hawthorn already threw Clarko under the bus, he's emerged from beneath it.

Clarkson's legal team needs to ensure it's Hawthorn bad first, staff bad after if the case against hfc is adverse.

I have every bit of reason to believe hfc will try to get clarkson in trouble if they find defending is too hard by moving the narrative towards 'oh clarkson had the run of the club, he was a bully and no one dared to say anything esp after he won that 08 flag'. Remember, kennet is always in the background, if anything he was the one who let this happen but this has blown up to proportions that he never thought of.

Yeah that's an enormous admission of guilt by them, Clarko did make the club employ the ILO too, so even that "defence" doesn't work.

Clarkson's legal team need to drag kennet's name through the mud and in front of himself.

Does Fagan get the same line of questioning at his presser's ? Clarko seems to cop it semi regularly, must be extremely annoying when everyone knows if something is before the courts, no comments can/should be made.

Clarkson mentioning the lawyers are the ones who hindered the resolution is most definitely not a random quote, this looks like the opening salvo.

He is building rapport with the players who targetting the leeches around the players who seek to make a big pile of cash off them. They are the ones who don't want the players to resolve thus causing this to get to this stage.

Clarkson should then openly do something to ensure 'full cooperation' of hfc and nudge the narrative to kennett being the main culprit of this entire affair. Also, public prejudice will most definitely people like kennett maguire are racists.

I'd be shocked if he's not called as a witness though.

Would be a complete hatchet job by Hawthorn and the players lawyers if he's left in the wilderness, though nothing is out of the realms of possibility I guess.


What everyone needs to be careful though is any follow up. If they freeze Clarko and Fagan out of a defence, there's going to be months of testimony under oath as ammunition for Clarkson's legal team to mount a pretty open and shut civil response if he feels aggrieved.

This has the potential to really go on for years if not resolved correctly.

You can't have more hard evidence generated that what will occur under oath here under cross examination.

For this reason, I doubt Hawthorn try and throw them under the bus completely.

Burgoyne and Brad Hill clearly abstained from these proceedings and based on Burgoyne's public comments regarding being shocked, these two bode as Hawthorn's biggest character witness' imo.

This is going to get very ugly. Defence lawyers will no doubt twist Burgoyne and Hill's testimonies against their brothers.

They have a job to do, they have ego's, they have career reputation's themselves.

There's considerations like not hanging out the coaches to dry, as they could face a rival suit with thousands of pages of evidence at the end of it.

The players have taken them to Federal Court, it will be open season, as it should be imo.

Was always what I've written these past 6 months, the mental health toll this will play on the players should have been front an center. It might be seen as heartless or racist, but $$$ seems to have been the motivation from the start and I think it's ultimately what it is. Who knows Rioli's situation, he may be broke for all we know. Their best chance of winning in this aspect was always weight of numbers. Egans involvement was always super dodgy, particularly with the initial suggested outcome of the report being a financial payout before even seeking evidence or confirming guilt was proven.

A silk and a federal court judge will have absolutely no sympathy once this gets started. They will find the weakest link and drill them. Which appears to be Peterson, I hope he is prepared in his private life for what he is about to face.

A silk will spend an hour on just those direct quotes in that one article mentioned a few pages back.

Pretty much all the players in question will be on the stand for a couple of days each more than likely.
