Is there a substantiated reason that you (and others) have bucketed Clarkson and Fagan like they are one and the same? They have different lawyer representation. They don't release joint statements. I am reasonably sure that they had different involvements in the the events that are listed by the complainants.

Burt, due only to his statements has a degree of separation but "bucketing" of the accused seems to be inaccurate. To this point, even considering the complainants are sharing a lawyer, the events that the complainants have applied to addressed will not be common to all of them. Any bucketing of complaints may need to need to be unraveled.

If the application for HRC investigation is successful, it will be a complex process.

I don’t doubt that there will turn out to be different levels of culpability. But both Fagan and Clarkson were allegedly present and involved in some of the most egregious alleged acts.

If you’re using either fagans legal letter or the complainants legal letter as a measure of truth then it’s a waste of time. The content of those letters is just part of a game of posturing.

Some people have relied on them to make some pretty interesting claims in this thread.

I wonder why Cyril didn't simply pick up the phone in the past 4-5 years if all he wanted was to be heard. Clarkson has reached out to Cyril many times since his retirement. Of course it's up to Cyril to determine the timing and method, but why not at least write a letter explaining how and why he was so hurt by whatever occurred. I suspect Clarkson never considered for a moment that Cyril would be leading the charge and wouldn't be surprised if the timing of Clarkson stepping away with mental health issues was when he found out it he was one of the claimants.

From the outside, it looks like the HL situation at Collingwood. They're told the door is open, but if they walk through that door and are critical of behaviour, they face denial and being told that their version is wrong. They're not actually listened to when they are critical.

Until the complete story is told how can you believe one sides version over the others?

I truly hope it goes to court and everyone has to testify under oath where there's nowhere to hide.

It’s about advancing your client’s interests. If you’re instructed to refute the allegations then it is your client’s innocence and credibility that you’re defending. And if you’re representing the complainant then of course the evidence undoubtedly demonstrates that other side has contravened relevant laws and so it would be in their best interests to stump up

To be honest if this whole saga is about a comment made about a pair of ripped jeans then its a ****ing travesty.

I’m hearing what you are saying re not being prepared to listen. Listening never hurt anybody.

Unfortunately though the way that it’s played out in the media has made that very difficult. And it hasn’t been helped in anyway by the afl’s rigid procedures for doing things.

Which might be a great place to start in overhauling the league for Aboriginal people. How should complaints like this be dealt with in the future? Bearing in mind the answer needs to do a better job of not burning the accused at the stake.
