I guess that depends on what people were after, how things have impacted them. I’m not saying you are one doing this, but assumptions that a pay out is the be all and end all for parties involved probably underestimates what people have been put through since this dragged out in the public eye.

I hope he ****in' squirms while he tries to explain how the actual investigation he commissioned wasn't a dismal ****ing failure. This outcome is completely and utterly unrelated to the panel's investigation. I hope he does the presser outside and a flock of birds crap on him, every single one of them too.

Id want Clarko, Fagan to have this tested in court. The mud has been slung and its stuck.
 
Surely this outcome gives no incentive for Clarko and Fagan to sign NDAs. "No findings against" goes nowhere near removing the taint of the unsubstantiated (and now, never to be substantiated) allegations against them.
Yes indeed, there has to be some sort of quid pro quo for someone to sign an NDA. For instance, you get access to information but you agree no to disclose. I don't ee any benefit for Clarko, Fagan, and Burt to stay quiet.
 
I have deliberately kept quiet on this - Clarkson initially was going to issue legal action way back when this first broke but suddenly the AFL enacted the investigation. My info now is that he will not be pursuing any of the ABC/Jackson nor Hawthorn or any of the families. He wants it finished. In spite of what Tom Browne has tweeted and what Robbo is carrying on about there will be no legal action from either side. I believe that only the human rights side will be pursued by the families however given the AFL agreement I understand there is doubt that anything can be proven against Clarkson Fagan and Burt even in that forum. Looks like this might well be the end of this shameful saga.
 

Hawthorn racism scandal: Gillon McLachlan to give update on independent investigation​

The AFL’s investigation into the Hawthorn racism saga is over – and there will be no adverse finding against Alastair Clarkson, Chris Fagan and Jason Burt.

The four First Nations families involved in the Hawthorn racism saga are destined for the Australian Human Rights Commission after the AFL’s independent investigation was wound up on Tuesday.

The families have agreed there will be no adverse finding against the AFL and current senior coaches Alastair Clarkson, Chris Fagan and former Hawthorn staff member Jason Burt.

The AFL has called a last-minute late-night press conference as its independent investigation into the Hawthorn racism scandal hits crisis point.

League boss Gillon McLachlan is set to front media at 7.45pm tonight, with the press conference only called at 7.04pm.

The four families are almost certain to join the two other families in pursuing a hearing in the Human Rights Commission.

That will involve compulsory mediation between the families and Clarkson, Fagan and Burt, who have all denied any wrongdoing.

And if conciliation can’t be reached a hearing will be held in the Federal Court.


The league announced on Tuesday evening that “no adverse findings have been made in the independent investigation against any of the individuals against whom allegations have been made”.

It said that all six complainants that had partaken in the investigation “wish to resolve all differences with the AFL”.

“As a result of this agreement, the complainants do not wish to pursue the independent panel investigation, which they wholeheartedly supported, or make any claims against the AFL in any other process (including the AHRC) or Court in relation to their allegations,” the league said in a statement.

The league’s panel was terminated “with the consent of the complainants with no charges to be brought against any person subject to the AFL Rules as a result of the independent investigation.”

The league acknowledged that complainants feel “hurt, pain and anguish following
their time at the Hawthorn FC”.

“The Parties acknowledge that the manner in which their allegations were leaked to the media
was not in any party’s best interests,” it said.

“The Complainants acknowledge that the Independent Panel established by the AFL was a
positive and constructive process for their allegations to be fully and fairly investigated in a
culturally safe way and that they have only agreed to the termination of that process because
of this agreement.”
It also made a number of commitments around ongoing training and greater diversity across the industry.

The league also noted that the agreement does not preclude the AFL “from bringing a charge under AFL Rules against Hawthorn FC with respect to the commissioning and oversight of the Binmada Report”, which was commissioned in 2022.

“The AFL greatly values all players and officials in our game and commits to working with all the clubs and all its people in continually improving the environments and ensuring they are welcoming, supportive and understanding of everyone who comes to our game,” it said.

“There have been hundreds of Aboriginal and Torres Strait Islander players who have played our game and who have collectively played more than 25,000 games.
“The AFL knows that during the long history of our game there have been instances of racism and that players have been marginalised, hurt or discriminated against because of their race and for that we say sorry.”
