No surprise (as I said) the Federal Court will take a dim view of what they would consider a waste of their time and resources, whoever doesn't fall into line and resolve this is going to be whacked with a very big stick by his honour, the lawyers all know this, Clarko just needs to either a/hand them the envelope with his terms (we don't believe Mr Clarkson is a racist and apologise in full for any such imputations BTW we are covering all his legal expenses) OR b/ wait until the 11th hour when Hawks and the other parties pull out drop proceedings and pay costs to all and sundry without admitting liability.AFAIK this is mediation ordered by the Fed Court no?
Will be interesting to see if Zwier keeps playing chicken - reckon it could get resolved here, but I've been wrong before.
Given we know the last mediation was good for Clarko, keen for this to go ahead as well.
It was widely reported and acknowledged that the grand sum of Chris Fagan's culpability is that he is alleged to have nodded once in a meeting. If you can't recognise false equivalence here, then your capacity for discernment is seriously wanting.

Reading that makes me think Rioli etc have been given wrong advice about how they approached this.
From around February 2009, Rotumah contacted Burt from time to time in respect of her inability to contact Peterson and her concerns in respect of Peterson’s continued drug use and behaviour;
(x) in October 2010, Peterson was delisted after the following events:
(i) Peterson was with the Hawthorn team in Perth for an elimination final when Rotumah informed Burt that Peterson had taken marijuana earlier in the week;

Hawthorn has sensationally claimed that alleged racism victim Carl Peterson was incoherent and appeared affected by drugs or alcohol when he was picked up by a club official at Melbourne Airport after a flight from Perth.
He also allegedly told David Flood, the Hawks’ then development coach, that he had no money in his bank account and lost his clothing.
More than two years after the Hawks racism scandal broke, lawyers for the club have made the explosive claims in a scathing Federal Court document on Thursday.
Hawthorn premiership legend Cyril Rioli is the lead applicant in a Federal Court action in which five former Hawks figures and their partners – Shannyn Ah Sam-Rioli, Peterson, Jermaine Miller-Lewis, Montanah-Rae Lewis and Leon Egan – are seeking damages, aggravated damages and apologies from the club.

In a statement of claim lodged in July, Rioli accused Alistair Clarkson of calling him “Humphrey B Bear” throughout his time at Hawthorn and “thereby associated Mr Rioli with a black bear and chose to publicly refer to him in that way”.
The AFL launched an “independent” inquiry into the Hawthorn racism claims in September 2022, which ended eight months later with “no adverse findings” made against Clarkson, former Hawks football boss Chris Fagan or club welfare chief Jason Burt.
Fagan was accused of “nodding his head” during the alleged Clarkson discussion with Peterson.
Clarkson, now senior coach at North Melbourne, Fagan, this year’s premiership coach at Brisbane, and Burt have repeatedly denied any wrongdoing.
Mediation between the players and former Hawthorn figures has failed to reach a resolution.
In May this year, the Herald Sun revealed two secret reports commissioned by the AFL into the Hawthorn racism scandal found “a startling lack of evidence” in the cases alleged against the trio.

The separate reports, authored by a retired Federal Court judge and a top city law firm, concluded that the gravest allegation – that an Indigenous player and his partner were pressured to terminate a pregnancy – could not be substantiated.
A claim that the Hawks had demanded the separation of another First Nations family for the sake of the player’s career was also considered to be “lacking in evidence”.
The two reports – one by Justice John Middleton and the other by Gordon Legal – found that there was “no basis whatsoever” to support suggestions a sub-culture of racism had existed at Hawthorn or that the three accused club officials had behaved in anything other than a “caring” way for their players.
The AFL Commission relied upon the reports to terminate the four-person independent investigation panel led by Bernard Quinn KC, which had failed to make any findings eight months after being established following the leaking of the Hawthorn “cultural safety review” in grand final week 2022.

Peterson was always going to be found out.Cyril aside I can’t take Egan’s cousin or Carl Peterson seriously in this case.
The whole investigation IMO was a gotcha process to try and get dirt on Clarko and co.
The fact that Kennett isn’t even accused of anything is laughable.
With Peterson being one of the players, his participation raises some serious eyebrows and gives the whole saga a good dose of illegitimacy.
The man’s an ice addict, a grub and has zero credibility.
Rioli was going to come out if a 6 year retirement? Colour me doubtful.After hearing from well-sourced posters on here that Cyril was on the cusp of joining North when Clarko came on board; it's jarring to read that he felt racially vilified by him as a player.
